INSURANCE BAD FAITH AND COVERAGE
On behalf of policyholders and other insureds, Fernandez Hennessy LLP, pursues claims against insurance companies. Insurance policies are legally binding contracts. The policyholder pays insurance premiums and the insurer agrees to defend and indemnify you if a covered event occurs. When an insurer fails to honor the terms of the policy (contract), the insured may have a claim for insurance bad faith.
Sometimes, an insurance company will cancel (rescind) your insurance policy retroactively after you file a legitimate claim. This practice is known as insurance rescission. In California, post claims underwriting (investigating an insured's application after a claim is filed) is illegal. Unfortunately for policyholders, many large insurers still illegally cancel insurance policies. When they do, this is also considered insurance bad faith for which the insured is entitled to damages. If your insurance company illegally canceled your policy or refused to pay on a theft loss claim, business claim, fire or flood damage claim, uninsured motorist policy, insurance claim, or any other type of insurance claim, Fernandez Hennessy LLP will take on the insurer and get you the fair monetary compensation you deserve.
